THE "GEARWRENCH® ULTIMATE GARAGE" SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.
A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
THE "GEARWRENCH® ULTIMATE GARAGE" SWEEPSTAKES (“Sweepstakes”) starts on March 1, 2008 and ends on June 30, 2008. The Sponsor of this Sweepstakes is Danaher Tool Group, 14600 York Road, Suite A, Sparks, MD 21152, a division of Easco Hand Tools Inc. (the “Sponsor”).
ELIGIBILITY: This Sweepstakes is open only to legal residents of the United States who are 18 years or older at time of entry. Employees and their immediate families (defined as parents, children, siblings, spouse, and life or domestic partners) of the Sponsor, GC Marketing Group (the “Administrator”), or any of their agents, affiliates, subsidiaries, parent and related companies, and those living in the households of same are not eligible. The laws of the United States apply to and govern this Sweepstakes and any claims must be raised and resolved in the United States. All Federal, state and local rules and regulations apply. Void where prohibited or restricted by law.
HOW TO ENTER:
Complete the entry form located at www.gearwrench.com/ultimategarage
ALL ENTRIES MUST BE SUBMITTED BY JUNE 30, 2008 AND RECEIVED BY JULY 7, 2008 TO BE ELIGIBLE FOR THE DRAWING.
To enter, fill out the form. After you have filled out the form, click “submit”. Failure to fill out the entire form or click “submit” will prevent your entry from being received. All fields in the entry form must be completed in order for us to send the prize, and the prize will only be sent to addresses within the United States. Limit one entry per household. Sponsor is not responsible for late, lost, illegible, incomplete, misdirected, damaged or postage-due entries or mail, or for entries submitted in a manner that is not specifically allowed under these Rules. All such entries will be void. Entries become the property of the Sponsor and will not be returned. Only official entry forms will be accepted. No mechanically reproduced, computer-generated or facsimile entries allowed. False and/or deceptive entries or acts shall render entrants ineligible.
Sponsor, Administrator, their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, printing vendors and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network; problems with or to computer online systems, computer equipment, servers, providers, printers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this
Sweepstakes; inability to access the Web Site or pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; printing, typographical or other errors; and any mailed entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible or postage due; or any combination thereof. Proof of mailing entry or entering information at the Web Site is not considered proof of delivery or receipt. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Sweepstakes Rules.
WINNER SELECTION: Winner will be selected in a random drawing from eligible entries received, to be held on or about July 7, 2008.The random drawing will be conducted by GC Marketing Group, “Administrator”, an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes.
Winners will be notified by telephone, email and/or mail within three (3) days of the random drawing and will be required to complete, execute (notarize) and return an Affidavit of Eligibility & Compliance/Release of Liability and (except where prohibited) a Publicity Release and a completed IRS W-9 form within ten (10) days of issuance. A return overnight delivery air bill will be provided to facilitate the return of any required documents. Failure to return all required documents in this time period may result in the winner being disqualified and an alternate winner selected. Prizes are guaranteed to be awarded. If a prize notification or prize is returned to Sponsor or its fulfillment companies as undeliverable for any reason, it will be awarded to an alternate. No substitution for a prize by the winner will be permitted. Prizes are subject to availability. If necessary due to unavailability, a prize of comparable or greater value will be awarded at the discretion of the Sponsor. Prizes are not transferable, assignable or redeemable for cash.
The winner is responsible for all costs not specifically included in the prize description, including, but not limited to, all Federal, state and local tax liabilities. Acceptance of a prize constitutes permission (except where prohibited) to use the winner's name, address (city and state only), likeness and statements for publicity purposes without additional compensation or limitation.
PRIZE: The prize to be awarded to the entrant selected in the random drawing is:
One GearWrench® Garage Prize will consist of GearWrench® Hand Tools of Sponsor’s choice. (ARV $5,000). We reserve the right to substitute prizes or terminate the sweepstakes at any time without notice. Prizes are not redeemable for cash.
The odds of winning the prize are determined by the total number of eligible entries received for the random drawing and are equal regardless of method of entry.
GENERAL: By entering this Sweepstakes, entrants agree that Sponsor, Administrator, their respective parent companies, affiliates and subsidiaries, and their respective employees, officers, directors, shareholders and agents, and any other companies participating in the design, administration or fulfillment of this Sweepstakes (collectively "Releasees"), shall not be liable
for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Sweepstakes or acceptance of or use or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, infringement of rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. The winner releases the Releasees from any and all liability and responsibility with respect to the prize (including any property loss, damage, personal injury or death). The winner acknowledges that the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize. If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or telephone number or Web Site associated therewith becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsors’ sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, Sponsors reserve the right to conduct a random drawing to award the prize from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification or suspension occurs, notification will be posted on the website at http://www.mscdirect.com. Any attempt by an entrant or any other individual to deliberately undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and Sponsors, shall be governed by, and construed in accordance with the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules or provisions (whether of Delaware, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Delaware. All claims relating to the Sweepstakes must be brought in the federal or state courts located in Wilmington, Delaware, which shall have exclusive jurisdiction and venue over such claims. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not included.
